Mumbai: Questioning the repeated word given bail to actor Sanjay Dutt who is serving a term of six years in jail in Pune, the Bombay High Court said today : ” What is the point of the rules and regulations, if a convict can enjoy 105 days out of jail ? “
Hearing a public interest litigation , or PIL against actor probation , the court also noted that the state government ” have not demonstrated that this diligence in cases where sentencing is a common man” and added that the State ” should exercise its discretion properly and should not discriminate . ”
The Court’s comments came a day after the Centre asked the Maharashtra government to explain why the 54-year- old actor , who is serving a prison sentence of six years in 1993 Mumbai blasts case series , has been given the special privilege of parole three times in the nine months he has been in jail .
Mr. Dutt was sentenced by the Supreme Court for illegal possession of weapons and was sentenced to six years in prison. He had previously served 18 months. Surrendered before a court in Mumbai in May to serve the remaining period.
The actor has been on parole since 21 December and was back to Yerawada jail in Pune on February 21 . Reports said that his probation was extended again until March 21 , on his request to be with his wife Manyata , who is said to be evil, and his twin sons .
Earlier, Maharashtra Home Minister RR Patil had said that the state government will investigate allegations that the actor was being provided alcohol in prison.
